How to Distinguish Defects from Wear
Design Defects

Material Defects
A material defect exists when a building product fails prematurely despite proper design and installation due to a manufacturing flaw or inherent product deficiency. Examples include sealant that fails to cure properly due to a formulation error, roofing membrane that decomposes prematurely, or window frames that warp due to inadequate material properties. Material defect claims often involve the product manufacturer as an additional responsible party.
Normal Wear and Maintenance Failures
Normal wear is the expected deterioration of building materials over time under typical service conditions. All building envelope components have finite service lives. Sealant joints typically last ten to twenty years. Traffic coatings on balcony decks may last eight to fifteen years. Single-ply roofing membranes carry twenty to thirty-year warranties under ideal conditions. When these components reach the end of their expected service life and begin to fail, that deterioration is generally not a construction defect — it is a maintenance and replacement obligation.
The distinction becomes blurred when components fail well before their expected service life. A sealant joint that fails at three years was either defectively installed, improperly specified, or made from defective material. A sealant joint that fails at eighteen years has likely reached a normal end of life. The specific timeline, the nature of the failure, and the comparison to industry-expected service lives are all factors that a forensic investigator evaluates.
